In the city of Pyt-Yaha Khanty-Mansiysk Autonomous Okrug – Ugra administration illegally denied a local man in custody with the agreement of social employment. Told a BakuToday reported July 11 in the press service of the Prosecutor of the Khanty-Mansiysk Autonomous Okrug – Ugra.
A check drawn on a complaint of a citizen, it was found that he had previously applied to the city administration on the conclusion of a treaty with him on social rented housing occupied, but officials in the exercise of this right is denied. The justification was stated that the grounds for concluding the said contract had occurred because the applicant is the father of living space, where it was provided on the job and with whom a contract of employment premises, drove out of the shelter to another permanent residence. Officials of the city administration decided that in this context, the contract shall be terminated, and the applicant must release the premises.
Meanwhile, the prosecutor noted, this rejection does not meet the requirements of federal law. Article 69 of the Housing Code of the Russian Federation provides that if a person has ceased to be a member of the family living space on the social contract of employment, but continues to live in occupied dwelling, for it retained the same rights as an employer and are members of his family. Contrary to the requirements of the law in the decision by officials of the city administration does not take into account that the applicant continues to reside in a residential area, and therefore has the right to enter into contract with social renting.
In connection with the identified violations of city prosecutor asked the court to protect the housing rights of the citizen. Decision of the court prosecutor demands are satisfied in full, at the city administration has the responsibility of the applicant to conclude an agreement on social rented housing.
